The 5 Health & Safety Mistakes Small Businesses Make (And How to Fix Them)

Running a small business means wearing a lot of hats. Health and safety often ends up at the bottom of the to-do list — not because business owners don't care, but because the day-to-day demands of keeping a business running leave little time for compliance.

The problem is, the HSE doesn't make allowances for being busy. Here are the five most common health and safety mistakes we see small businesses make, and what to do about each one.

Mistake 1 — Assuming Health & Safety Doesn't Apply to You

One of the most persistent myths in the small business world is that health and safety law only applies to large companies or high-risk industries. It doesn't. The Health and Safety at Work Act 1974 applies to every UK employer, regardless of size or sector. Even if you run a small office with three members of staff, you have legal obligations — including the duty to provide a safe working environment, adequate first aid provision, and appropriate risk assessments.

The fix: Understand your baseline obligations. If you haven't already, start with a simple health and safety needs assessment for your business.

Mistake 2 — Not Having Written Risk Assessments

Under the Management of Health and Safety at Work Regulations 1999, any business with five or more employees must have written risk assessments. Even for businesses below that threshold, carrying out and recording risk assessments is considered best practice and provides crucial protection if an incident ever occurs.

A risk assessment doesn't need to be complicated. It simply needs to identify what could cause harm, who could be harmed, and what you're doing to control that risk.

The fix: Get your risk assessments written, documented, and shared with relevant staff. If you're not sure how, a health and safety consultant can carry these out on your behalf quickly and cost-effectively.

Mistake 3 — Letting First Aid Qualifications Expire

First Aid at Work certificates are valid for three years. After that, they must be renewed — and it's surprisingly easy for renewal dates to slip by unnoticed, particularly in small teams where one person holds the qualification and nobody else is tracking it.

An expired first aid qualification means you're non-compliant, and in the event of an incident, your insurance could be affected too.

Mistake 4 — Ignoring Fire Safety Obligations

The Regulatory Reform (Fire Safety) Order 2005 requires most UK workplaces to have a written Fire Risk Assessment carried out by a competent person. Many small businesses either don't have one at all, or have one that's out of date or doesn't reflect their current premises.

Fire safety also extends to ensuring adequate fire extinguisher provision, working alarm systems, clearly marked escape routes, and trained fire marshals where required.

The fix: Commission a Fire Risk Assessment from a qualified consultant, and make sure it's reviewed annually or whenever significant changes are made to your premises.

Mistake 5 — Having No Health & Safety Policy

If your business employs five or more people, you're legally required to have a written health and safety policy. This document sets out your commitment to managing health and safety, who is responsible for what, and the arrangements you have in place to deliver on that commitment.

Many small businesses either don't have a policy at all, or have downloaded a generic template that bears no resemblance to how their business actually operates. A policy that doesn't reflect your real working practices is of limited value in the event of an HSE inspection or a workplace incident.

The fix: Have a bespoke health and safety policy written for your business — one that accurately reflects your operations, your risks, and your responsibilities.
